Model Release for models for Workshops/Events 2021

Article 1 - Privacy statement (GPDR)

It is not allowed to publicly share personal information related to this photo session. All personal information will only be used for internal purposes. This means that at no time information is given to third parties or in any way made available to people not included in this agreement. Neither the photographer, nor the model, parent(s)/guardian will in the future intentionally use facts and/or results, which are directly related to this agreement, to the detriment of the other.

Article 2 – General & Styles

No compensation can be claimed by the model or any other party named in this release if the photo session cannot take place due to technical defects, or if the photos have failed, been deleted or damaged as a result. Guidance before and after the actual photoshoot is not a problem at all. During the actual photo session, the photographer may ask the model's supervisor to leave the shoot, if the model is inhibited in being herself spontaneously or if the photographer is disturbed in his work.

It was agreed that the following photos could be taken during this photo session:

Article 3 - Image right

The model explicitly authorizes the photographer to place a selection of the images on his own website, to use them for participation in photo competitions, to publish them in magazines based around photography and retouching or to show them at exhibitions, to place them on forums, to use them as a portfolio or as an example in advertisements. The model also gives permission to use the photos taken during this session in retouching tutorials, online on YouTube and during livestreams on Twitch. The photos on the website are protected by copyright but the photographer cannot be held liable if the image is placed elsewhere on the internet without his knowledge.

Article 4 - Copyright

The model confirmed that he/she understands not to be able to claim the copyright and the copyright (including possession) of the processed and raw photos taken. The model and any promotional agency, model agency or website have to mention the name of the photographer with each publication, with the mention 'Gunther Frans Photography'. Only the photographer has the copyright and publication rights. The publication of a promotional photo on a modelling agency's website does not automatically give the agency the rights to the photos. The model and any modelling agencies that publishes the photographs agree to keep the digitized photographs in their original form. Reductions while maintaining the original proportions are permitted, but cutting, image processing, filters and the insertion or removal of additional texts and logos is not permitted. The model has no exclusive right to the images taken, nor to the style or treatments applied to the photos.

Article 5 - Right of publication

Both the photographer and the model have the right to publish the photos for promotional purposes, stating the name of the photographer and model. The model agrees to inform the photographer of any publication. This is done by clearly mentioning all references of the publication (website, name of publication or model agency etc...) in an email. It is forbidden for both parties to commercially exploit the photos, unless by mutual consent according to a new agreement to be made. Exceptions for this are Article 10 and Article 11 of this document. It is not allowed for both photographer and model to place the photos on websites with erotic, pornographic or illegal content. Exceptions are Onlyfans & Patreon if agreed in article 10.

Article 6 - TF (Time for)

The model does not receive a fee or travel expenses for posing, but a compensation in the form of a DOWNLOAD with the selected photos of the session in high resolution. Printing of the pictures is not available. The model can have the photos printed on the DOWNLOAD at its own expense at a local print service. TF shoots offered by the photographer are free for a minimum time of 2 hours. After this the photographer has the right to end the shoot. The costs for makeup and make-up artist, styling if necessary, are at the expense of the model if it was requested by her. The model is also entitled to 5 free retouched images delivered in a period of 14 days. These 5 photos are chosen together from which the photographer then makes a final selection. Additional photos that fall outside of these standard 5 photos can be purchased if desired.

Article 7 - Delivery of files

The digital files are made available free of charge by email via a download link on WeTransfer.

Article 8 - Extra

Upon the digital signing of this model agreement, the model as mentioned above confirms that all photos were taken without any encouragement or coercion from the photographer and/or other parties present during this photo session. The styles that have been shot during this session were all agreed by the model and she agrees by signing this document that she was not obligated by anyone for shooting these styles/kinds of images.

Article 9 - Shooting evenings / cancellation policy

This shoot is done on TF basis (see article 6). For this purpose, the model will be on an agreed date during a shoot event/workshop which lasts minimum 4 hours or longer. During this time different photographers may photograph the model in the style discussed. The model gets paid for this depending on the style the shoot. If the model cancels this shoot evening for any reason, she is responsible for 50% of the lost income. Only a doctor's note as proof can be valid in case of cancellation and be considered as the only valid reason why the amount due of 50% of the total income lapses.

If the model decides after signing this document to no longer be interested in such a workshop/event she has to pay the fees for the shoot which can be found on the website www.guntherfrans.be on top of the 50% loss of income.

Article 10 – Patreon & Onlyfans

The model states that photographer Gunther Frans may use the photos from this session online on his Patreon / OnlyFans account: YES/NO

Gunther Frans declares that the model can use these photos on her Patreon / OnlyFans account: YES/NO

Article 11 – Merchandising

Images taken during this photo session may be used by Gunther Frans for digital manipulation on merchandising (T-Shirts / Calendars / etc. ...)

As a result, the model is entitled to 15% of the income on sales where her images are on.

Article 12 - Nude & Erotic images

Depending on the agreed styles in Article 2 some pictures will be taken for this shoot of the model naked on which more intimate zones are visible. The model also declares to be of legal age (18 or older).
